These Terms of Use ("Terms") govern your access to and use of the MoodMonkey mobile application and related services (collectively, the "Service"). By creating an account or using MoodMonkey, you agree to be bound by these Terms.
If you do not agree to these Terms, please do not use our Service.
1. Acceptance of Terms
By accessing or using MoodMonkey, you acknowledge that you have read, understood, and agree to be bound by:

These Terms constitute a legally binding agreement between you and MoodMonkey. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.
2. Description of Service
2.1 What MoodMonkey Provides
MoodMonkey is a private mood journaling application with trusted circle sharing and emergency support features. The Service helps you:
- Track your emotional states and moods over time with micro-journaling
- Share authentic moments with your small, trusted circle (up to 10 people)
- Access critical SOS emergency alerts to notify your circle during crisis moments
- Create micro-journal entries with rich media (photos, voice notes, location)
- Visualize your mood patterns through interactive analytics
- Receive gentle notification nudges to maintain journaling habits
- Access guided reflection prompts and wellness tools (breathing exercises, music)
- Export and backup your encrypted journal data
2.2 Service Modifications
We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time, with or without notice. We will make reasonable efforts to notify users of significant changes.
3. Account Registration & Security
3.1 Account Creation
To use MoodMonkey, you must:
- Be at least 13 years of age
- Provide accurate and complete registration information
- Maintain and update your account information
- Create a strong, unique password
3.2 Account Security
You are responsible for:
- Maintaining the confidentiality of your password
- All activities that occur under your account
- Notifying us immediately of any unauthorized access
Important: Due to our zero-knowledge encryption, if you lose your password, we cannot recover your encrypted journal entries. Please keep your password safe and consider enabling two-factor authentication.
3.3 Account Limitations
- One person may only create one account
- Accounts are non-transferable
- You may not share your account credentials with others
4. User Responsibilities
4.1 Acceptable Use
When using MoodMonkey, you agree to:
- Use the Service for personal, non-commercial purposes
- Comply with all applicable laws and regulations
- Respect the intellectual property rights of others
- Not interfere with or disrupt the Service
4.2 Prohibited Activities
You agree NOT to:
- Reverse engineer, decompile, or disassemble the app
- Use automated systems (bots, scrapers) to access the Service
- Attempt to gain unauthorized access to our systems
- Upload malware, viruses, or malicious code
- Harass, abuse, or harm others through the Service
- Use the Service for any illegal purpose
- Violate any applicable laws or regulations
4.3 User Content
You retain ownership of your journal entries and content. However, you grant us a limited license to:
- Store your encrypted content on our servers
- Process your content to provide the Service
- Create backups for data protection
Remember: Your content is end-to-end encrypted, so we cannot access the actual content of your journal entries.
5. Subscription & Billing
5.1 Free and Paid Plans
MoodMonkey offers both free and paid subscription plans:
- Free Plan: Basic features with limitations
- Pro Plan: Monthly subscription with advanced features
- Lifetime Plan: One-time purchase for permanent access
5.2 Billing
- Subscription fees are billed in advance on a recurring basis
- Payments are processed through third-party payment providers (Stripe, Apple, Google)
- Prices are subject to change with 30 days notice
- We do not store your credit card information
5.3 Free Trial
- New users may receive a 7-day free trial of Pro features
- You will be charged after the trial period unless you cancel
- Cancel anytime during the trial to avoid charges
5.4 Refunds
We offer refunds under the following conditions:
- Within 30 days of purchase if you're not satisfied
- For technical issues that prevent Service usage
- If we discontinue the Service
For App Store and Google Play purchases, refunds are subject to their respective refund policies.
5.5 Cancellation
- You can cancel your subscription at any time
- Cancellation takes effect at the end of the current billing period
- You retain access to Pro features until the end of the paid period
- Your data is retained for 90 days after cancellation
6. Intellectual Property
6.1 MoodMonkey's Rights
MoodMonkey and its original content, features, and functionality are owned by us and are protected by:
- Copyright laws
- Trademark laws
- Patent laws
- Other intellectual property laws
6.2 Limited License
We grant you a limited, non-exclusive, non-transferable license to:
- Download and use the app on your personal devices
- Access and use the Service for personal purposes
6.3 Restrictions
You may not:
- Copy, modify, or distribute the app
- Remove copyright or proprietary notices
- Use our trademarks without permission
- Create derivative works
7. Privacy & Data Protection
Your privacy is important to us. Our collection, use, and protection of your personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.

- End-to-end encryption of all journal entries
- Zero-knowledge architecture (we cannot read your entries)
- No selling of personal data to third parties
- Compliance with GDPR, CCPA, and other privacy regulations
- You can export and delete your data at any time
8. Disclaimers & Medical Advice

MoodMonkey is NOT a substitute for professional medical advice, diagnosis, or treatment.
Our app is designed to help you track and reflect on your emotions, but it:
- Does NOT provide medical, psychiatric, or therapeutic services
- Does NOT diagnose mental health conditions
- Does NOT replace consultation with qualified healthcare providers
- Should NOT be used in medical emergencies
8.1 When to Seek Professional Help
If you are experiencing any of the following, please seek immediate professional help:
- Thoughts of self-harm or suicide
- Severe depression or anxiety
- Mental health crisis
- Substance abuse issues

8.2 SOS Emergency Feature Disclaimer
CRITICAL: The SOS emergency feature is NOT a replacement for 911 or professional emergency services.
The SOS feature connects you to your designated emergency contacts (friends, family, or trusted individuals) for emotional support during a crisis. It is designed to:
- Alert your trusted circle via push notifications and WhatsApp messages
- Share your GPS location with emergency contacts to help them reach you
- Provide a quick way to signal you need support from people who care about you
The SOS feature does NOT:
- Contact professional emergency services (police, ambulance, fire department)
- Provide medical, psychiatric, or crisis intervention services
- Guarantee immediate response from your emergency contacts
- Replace professional mental health crisis support
For life-threatening emergencies: Always call 911 (US) or your local emergency services number first. Use the SOS feature as supplementary support from your personal network, not as your primary emergency response.
Limitations: The SOS feature requires network connectivity. Offline functionality queues alerts but does not guarantee delivery. Location accuracy depends on GPS signal strength. Your emergency contacts may not always be available or able to respond immediately.
Your Responsibility: By using the SOS feature, you acknowledge that MoodMonkey is not responsible for the actions or responses of your emergency contacts, the accuracy of location data, or any delays in message delivery.
8.3 No Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, either express or implied, including but not limited to:
- Warranties of merchantability
- Fitness for a particular purpose
- Non-infringement
- Accuracy, reliability, or availability
We do not guarantee that the Service will be uninterrupted, secure, or error-free.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, MOODMONKEY SHALL NOT BE LIABLE FOR:
- Indirect, incidental, or consequential damages
- Loss of profits, data, or business opportunities
- Personal injury or property damage resulting from your use of the Service
- Unauthorized access to your encrypted data
- Errors, mistakes, or inaccuracies in content
- Service interruptions or termination
OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE PAST 12 MONTHS, OR $100, WHICHEVER IS GREATER.
Some jurisdictions do not allow the exclusion of certain warranties or limitations of liability, so the above may not apply to you.
10. Termination
10.1 Termination by You
You may terminate your account at any time by:
- Using the account deletion feature in the app settings
- Contacting our support team at support@moodmonkey.app
10.2 Termination by Us
We may suspend or terminate your account if:
- You violate these Terms
- You engage in fraudulent or illegal activities
- Your account remains inactive for more than 2 years
- We are required to do so by law
10.3 Effects of Termination
Upon termination:
- Your access to the Service will be immediately revoked
- Your encrypted data will be retained for 30 days, then permanently deleted
- You can export your data before deletion
- Paid subscriptions will not be refunded except as described in Section 5.4
11. Dispute Resolution
11.1 Informal Resolution
Before filing a legal claim, please contact us at legal@moodmonkey.app to attempt to resolve the dispute informally. We'll work in good faith to resolve any issues.
11.2 Arbitration
Any disputes arising from these Terms shall be resolved through binding arbitration, except:
- Small claims court disputes
- Intellectual property disputes
- Where arbitration is prohibited by law
11.3 Governing Law
These Terms are governed by the laws of the State of California, United States, without regard to conflict of law principles.
11.4 Class Action Waiver
You agree to resolve disputes with us on an individual basis and waive your right to participate in class actions, class arbitrations, or representative actions.
12. Changes to Terms
We may update these Terms from time to time. When we make changes, we will:
- Update the "Last Updated" date at the top of this page
- Notify you via email or in-app notification
- For material changes, provide 30 days notice before they take effect
Your continued use of the Service after changes become effective constitutes acceptance of the updated Terms. If you don't agree to the new Terms, you must stop using the Service and may delete your account.
